Staffmark Group, LLC and its subsidiaries Staffmark Investment LLC (also doing business as Advantage Resourcing, Digital People, Employee Management Services, Hunter Hamilton, and Pro Staff,), Hire Thinking, Inc. dba Advantage XPO, Advantage Technical Resourcing, Inc., Advantage Technical Services, Inc. and Technical Aid Corporation (collectively “Staffmark,” “we,” or “us”) is committed to protecting the privacy and security of personal information. This Privacy Policy describes how Staffmark collects and uses your information.

1. SCOPE 

This Privacy Policy describes the treatment of information collected by Staffmark from natural persons, and applies to all ways we collect information, including on the Staffmark websites, through the online account portals, through the WorkNOW, Indeed Flex and other similar apps and websites that assist in your employment, in email, text, and other electronic communications, and offline in person, by mail, or by telephone. Staffmark follows this Privacy Policy in accordance with applicable law in the places where we operate. By continuing to provide your information to Staffmark, including through the use of our website, you are accepting the terms of Staffmark’s data practices as detailed this Privacy Policy.

Please keep in mind that when you provide information to us on a third-party site or platform (for example, via separate job application websites), the information you provide may be separately collected by the third-party site or platform. Only the information we collect is covered by this Privacy Policy, and the information the third-party site or platform collects is subject to the third-party site or platform’s privacy practices. Privacy choices you have made on the third-party site or platform will not apply to our use of the information we have collected directly. Please also keep in mind that our website and applications may contain links to other sites not owned or controlled by us and we are not responsible for the privacy practices of those sites.

 

2. HOW WE COLLECT INFORMATION

We collect personal information directly from you when you apply for a job with us or one of our We collect information directly from you when you apply for a job with us or one of our recruiting clients, respond to a posting, supply information for your benefit elections and for human resource administration, or in context of your employment with us. We also collect information when you provide to us when you make an account with us, sign up for communications with us, and during communications between us.

We may also acquire your information from third party sources including through running background, consumer, and employment eligibility verification checks, and/or from information provided by references you listed on your job application, as well as from publicly available sources of information.

We also indirectly and passively collect information provided by your web browser when you visit our websites and applications. We, or a service provider that operates the Services or any features therein, collects, stores, and processes information that is automatically collected when you use or access Staffmark’s websites. We (or such service provider) automatically collect Internet protocol (IP) address information (e.g., browser type and date/time stamp) when you access the Services. It is possible that we (or such service provider) would be able to identify you by a combination of your IP address and other information.

3. INFORMATION WE COLLECT AND HOW WE USE IT 

Staffmark collects the following main types of your information: personal information (data that

identifies you as an individual or relates to an identifiable individual or household) (“Personal Information”), sensitive personal information (data that reveals certain categories of information as defined in the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA”)) (“Sensitive Personal Information”) and anonymous information (collectively, “information”).

The categories of Personal Information and Sensitive Personal Information Staffmark collects and how and for what purpose we use it will vary depending on the relationship we have with you (e.g. whether you are applying for a job or position with us, whether you are a client or vendor, or someone else) and the context it is provided in. Job Applicants Applying for Employment or Temporary Staffing with Staffmark, Independent Contractors, and Existing Staffmark Employees

Staffmark collects and processes Personal Information and Sensitive Personal Information from applicants for employment with Staffmark, to make employment decisions that involve you and determine your eligibility for temporary staffing employment and/or full time employment with Staffmark, fulfill human resource, employment, and benefit administration purposes, where necessary to comply with any local, state, and federal legal obligations and laws, and for you to maintain your online account with us and personalize your preferences. Staffmark may also use the Personal Information or Sensitive Personal Information collected to maintain your employee account with us or provide you with employment as a temporary with another entity. Recruiting and Professional Placement Position Applicants

As part of Staffmark’s recruiting division, Staffmark solicits, recruits, and evaluates applicants for professional placement positions, for customers and clients that hire Staffmark to fill those positions directly at their companies. Automatically Collected Anonymous Information

Anonymous information means information that does not identify an individual applicant.  We may also use anonymous information to create aggregate information. Aggregate information means information about groups or categories of applicants and/or visitors to our website, which does not identify and cannot reasonably be used to identify an individual job applicant, employee, or website visitor. Staffmark uses anonymous data to maintain, operate, and improve our websites, including to analyze website traffic and run analytics. Staffmark may also use anonymous and aggregated information to analyze its business performance, including for pay equity reports.

4. SHARING YOUR INFORMATION WITH OTHERS

Staffmark does not sell or share[1] your Personal Information or your Sensitive Personal Information to or with third parties and has not sold or shared your Personal Information or Sensitive Personal information in the past 12 months. Sensitive Personal Information is only collected or processed to perform the services on behalf of the business listed above, to prevent detect or investigate security incidents, to resist malicious, deceptive or fraudulent or illegal action, to ensure the physical safety of natural persons, and to perform the services reasonably expected by you when you disclosed the information. Sensitive Personal Information is not used to infer characteristics about any consumer. Staffmark only discloses your information to the extent necessary to its Service Providers for purposes of human resources administration, to provide you with employment or secure your employment with another entity working with Staffmark, to service providers to provide you with employee benefits, process any benefit and employment claims, and administer checks, tests, and evaluations, to determine your employment eligibility and verification, to applications and websites that allow you to apply for Staffmark assignments and assist in scheduling such as WorkNOW and Indeed Flex, and to websites and apps that provide you with perks and benefits relating to your employment.

Staffmark may also disclose all categories of information when legally permitted or required by law, including to law enforcement or other government agencies, tax authorities, applicable regulators (or in response to requests from such parties), in the context of litigation or when we otherwise believe in good faith that such disclosure is necessary or appropriate in connection with any activity that violates law.

Staffmark may share anonymous data with its Internet and Technology Service Providers and Analytics Providers and Vendors to analyze our website traffic and improve its performance. Staffmark may also share anonymous and/or aggregated data to analyze its performance as a company, including for pay equity reports and for job satisfaction analysis.

5. MINOR INFORMATION

Staffmark does not knowingly or intentionally employ, recruit, or place for employment anyone under the age of eighteen (18), Staffmark’s websites are not directed to individuals under 18, and we do not knowingly collect Personal Information from individuals under 18. Individuals under 18 should consult with their parent or guardian about the use of this website. Staffmark does not collect information directly from any minors under the age of 16 and does not sell the information of minors under the age of 16 without authorization.

6. RIGHTS OF CALIFORNIA CONSUMERS

The CCPA provides California residents with certain rights regarding their Personal Information. This section explains how California consumers can exercise those rights.

Exemptions

Information collected in certain situations may be exempt from certain CCPA requirements regarding consumer requests. Some exemptions include, but are not limited to, information that must be retained under certain labor and employment laws, information needed to complete transactions, information necessary for the legitimate interests of Staffmark. or information that is disclosed or obtained by Staffmark that is covered by other legislative requirements, such as the Federal Credit Reporting Act (FCRA).

Right to Request Access and Disclosure About the Personal Information Collected About You

California residents have the right to request that Staffmark disclose certain information to you about our collection and use of your Personal Information or Sensitive Personal Information over the past twelve (12) months.

However, Staffmark will not at any time in response to a request disclose a consumer’s certain sensitive personal identifiers, sensitive financial information, or account login and password information. Account number or an account password, or security questions and answers. Staffmark is not required to retain any Personal Information collected for a single, one-time transaction, if the information is not regularly retained by Staffmark, or re-identify any anonymous or de-identified information, in order to disclose that information to you.

Right to Delete the Information We Have Collected About You

California residents also have the right to request that Staffmark delete your Personal Information or Sensitive Personal Information that we collected from you and retained, subject to certain exceptions. Once we have received and verified your identity and request, we will delete your Personal Information or Sensitive Personal Information from our records, unless an exception applies.

We may deny your deletion request, in whole or in part, if retaining the information is necessary for us or our service provider(s) to:

1.      Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

2.      Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

3.      Debug products to identify and repair errors that impair existing intended functionality.

4.      Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

5.      Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

6.      Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.

7.      Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

8.      Comply with a legal obligation.

9.      Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Correct the Information We Have Collected About You

California residents also have the right to request that Staffmark correct your Personal Information or Sensitive Personal Information that we collected from you and retained, subject to certain exceptions. Once we have received and verified your identity and request and confirmed that it is inaccurate, we will correct your Personal Information or Sensitive Personal Information in our records, unless an exception applies. 

You must make a good faith effort to provide all necessary information establishing that the information to be corrected is inaccurate at the time of your request.  We may require additional documentation to establish the inaccuracy of the information. 

Any documentation provided in connection with a request to correct shall only be used the purpose of correcting the information and to comply with our record keeping obligations.

We may deny your correct request, in whole or in part and will inform you of our reasons for doing so, including any conflict with law, exception to the right, if the request is fraudulent or abusive, inadequacy in required documentation or if compliance proves impossible or requires disproportionate effort.  We may choose to delete the contested information as an alternative to correcting if deletion would not negatively impact you or if you consent to deletion.

We will respond to your requests within the applicable time periods and in the manner prescribed by the CCPA. You may only make a verifiable consumer request for data portability twice within a 12-month period.

In connection with any privacy-related requests you submit to us in exercising rights to which you are entitled under applicable law, we will undertake steps to verify your identity. We may ask you to provide information that we have on file about you or, if the request is submitted in writing or electronically, we may contact you via another method (e.g., telephone) to verify your identity. We will only use Personal Information provided in a request to verify the requestor’s identity and authority to make the request and we will maintain a record of any such requests as required by law. If we are unable to verify your identity, we will not be able to fulfill your request.

You may also make a request through an Authorized Agent. Your designated agent must provide proof of signed permission that you have given them the authority and right to submit the request. Agents will be required to verify their own identify, as well as that of the consumer they are submitting the request for. Non-Discrimination

Staffmark will not deny services, charge different prices, offer a different quality of service, or otherwise discriminate against an individual for exercising the rights afforded to him or her under the CCPA.

7. RETENTION OF PERSONAL INFORMATION

Staffmark retains your information in accordance with its retention policies which consider the expressly indicated purposes for which we have collected the information, the retention periods that are reasonably necessary to achieve that purpose and applicable laws.

8. DATA SECURITY

The security, integrity, and confidentiality of your information are extremely important to us. Staffmark has implemented technical and administrative security measures that are designed to protect information from unauthorized access, disclosure, use, and modification. Staffmark restricts and regulates access to Personal Information and Sensitive Personal Information.  Unfortunately, despite such measures, no data transmission over the Internet and no database or other depository of information can be one hundred percent secure. As a result, while we will strive to protect your information, we cannot and do not guarantee or warrant the security of any of your information.

9. COOKIES AND ANALYTICAL TOOLS

When accessing and visiting our website, data may be collected from you through the use of cookies, which are sent to your computer and saved automatically. We use cookies primarily to maintain, operate, and improve your experience on our website, including to analyze website traffic and run analytics, remember your preferences, and optimize your experience by personalizing content. Most browsers support cookies and allow visitors to disable or block them. You can set your browser so that all cookies will be rejected or that you will receive a message when a cookie is being sent. However, some functions or services on our website may not work properly without cookies. Unless you disable cookies or do not accept our cookies, by using our website and online services, you agree that you accept these types of cookies and related technologies on your device. Analytic tools, such as Google Analytics, may also be used to help make our website work better and help us understand how you use our website and what parts of our website are being utilized. Do not track

Some internet browsers have a “do not track” feature. It lets you tell websites you visit that you do not want them to track your online activity. These features are not yet uniform across browsers. Our websites are not currently set up to respond to these signals.

If you no longer want to receive marketing-related emails from us on a going-forward basis, you may also opt-out by using the unsubscribe button in each email. If you no longer wish to receive marketing-related texts from us on a going-forward basis, you may also opt-out by texting “STOP” to us at any time.

11. Changes to our Privacy Policy

This Privacy Policy may be updated or changed periodically. The most current version of this Privacy Policy will govern the use of your information.
